Reduction and Recycling Law in Puerto Rico

The operational processes of companies and offices typically produce an excess of recyclable materials such as cardboard, paper, newspaper, plastic, aluminum, glass, metal, among others. As declared by Law 70 of 1992, if these companies employ more than 10 people, whether full or part time, they must develop and implement a recycling plan. This law is better known as the Reduction and Recycling Law in Puerto Rico.

It is important to note that within the chain of the “3R’s of recycling”, the logical order is: reduce, reuse and recycle. After taking all necessary measures to reduce the effects and materials acquired for business purposes and look for ways to reuse those that can be repurposed, we arrive at the recycling activity. This process consists of recovering recyclable materials which were discarded and use them to develop new products.

Law 70 of 1992 makes it mandatory that people, state agencies and public corporations that generate recyclable waste categorize them as part of a recycling program. Any natural or legal person found in violation of Law 70, may be penalized with fines of up to $25,000 for each infraction.

To comply with this law, some of the procedures that companies must perform include:

  • appointment of a coordinator
  • viability study
  • market analysis
  • generate sales contracts for paper waste
  • renegotiation of service contracts for waste disposal
  • development and implementation of collection, storage, hauling and disposal processes
  • employee education and advertising
  • continuous operation of the program
  • among others
